These Terms of Service (“Terms”) govern your purchase, download, printing, and use of the Pick A Penalty printable sports watch party game (the “Product”) made available at www.pickapenalty.com (the “Website”).

Pick A Penalty is operated by AmpliFire Productions, LLC, a Colorado limited liability company doing business as Pick A Penalty (“Company,” “we,” “us,” or “our”).

By purchasing, downloading, printing, or using the Product, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old to purchase the Product.

The Product is not intended for children under 13. We do not knowingly collect personal information from children under 13.

2. Product Description

Pick A Penalty is a printable sports watch party game delivered in PDF format.

The Product is designed to be:
   •   Downloaded
   •   Printed
   •   Cut into physical cards
   •   Used at in-person social gatherings

The Company does not provide an online gaming platform or digital wagering system.

You are responsible for ensuring that you have the ability to:
   •   Open PDF files
   •   Print the Product
   •   Cut and prepare printed materials for gameplay

We do not guarantee compatibility with all devices, printers, or third-party print services.

3. License Grant (Personal Use Only)

Upon purchase, you are granted a limited, non-exclusive, non-transferable, non-sublicensable license to download, print, cut, and use the Product in physical form for personal, non-commercial use only.

You may:
• Print unlimited copies for your own household
• Print copies for in-person social gatherings that you personally host

You may NOT:
   •   Share the digital file with others
   •   Email or transfer the PDF to third parties
   •   Upload the file to file-sharing services (including but not limited to Google Drive, Dropbox, or similar platforms)
   •   Post the Product online
   •   Resell, redistribute, sublicense, or commercially exploit the Product
   •   Modify, rebrand, or create derivative works
   •   Use the Product at bars, venues, corporate events, ticketed events, or commercial locations

Commercial use requires a separate written license agreement from the Company.

All rights not expressly granted are reserved.

4. Entertainment Purpose Only; No Gambling Services

Pick A Penalty is a physical party game intended for entertainment during sports watch gatherings.

The Company:
   •   Does not operate a gambling platform
   •   Does not collect, hold, or distribute money
   •   Does not manage pot distributions
   •   Does not facilitate betting or wagering

Any references to “pot,” “pot share,” or “winnings” refer solely to gameplay mechanics.

Participants may independently decide how to structure gameplay among themselves. The Company does not require or recommend the exchange of money to play.

You are solely responsible for complying with all applicable laws in your jurisdiction. The Product may not be used for unlawful gambling activity.

5. Non-Affiliation

Pick A Penalty is an independent game and is not affiliated with, endorsed by, or sponsored by any professional sports league, team, or governing body.

Any references to sports penalties are descriptive in nature only.

6. Pricing, Payments, and Taxes

All purchases are processed by our merchant of record provider (currently Lemon Squeezy or its successor).

Prices are listed in U.S. dollars unless otherwise stated.

Applicable taxes may be calculated and collected at checkout as required by law.

We reserve the right to modify pricing at any time.

7. Refund Policy

Due to the digital delivery of the printable Product, all sales are final.

Limited exceptions may apply for duplicate purchases made using the same email address or corrupted file delivery, subject to our standalone Refund Policy.

Refund requests must be submitted within 7 days of purchase and include required supporting information.

If a payment dispute or chargeback is initiated, we reserve the right to revoke your license and deny future purchases.

8. Intellectual Property

The Product, including all content, graphics, game mechanics, branding, layout, and design, is the exclusive property of the Company and is protected by copyright and other intellectual property laws.

Unauthorized reproduction, distribution, or commercial use is strictly prohibited.

9. Limitation of Liability

To the fullest extent permitted by law:

The Company shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the purchase, printing, or use of the Product.

Our total liability shall not exceed the amount you paid for the Product in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless the Company from any claims, damages, or expenses arising from:
   •   Your misuse of the Product
   •   Your violation of these Terms
   •   Your unlawful use of the Product

11. Arbitration and Class Action Waiver

Any dispute arising out of or relating to these Terms or the Product shall be resolved through binding arbitration conducted in Colorado.

You waive the right to:
• A jury trial
• Participate in a class action or class arbitration

All disputes must be brought on an individual basis.

12. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles.

13. Changes to Terms

We may update these Terms at any time. The updated version will be posted on the Website with a revised “Last Updated” date.

Continued purchase or use of the Product constitutes acceptance of the updated Terms.
